GENERAL WARRANTY CONDITIONS

 

1. The warranty covers all damage arising during the warranty period, including latent defects in the material or factory assembly defects discovered during that period.
2. If the subject of this warranty is a series of products and warranty will be realized only in part to this series, for warranty purposes described range by the concept of the product should be understood that part of the set.
3. The manufacturer guarantees that light deterioration during the warranty period will not exceed the 30% from nominal luminous flux.

5. In the performance of warranty obligations, the Guarantor can fixed or replace new product.
6. The warranty repair of the Product shall be performed within 14 working days from the date the faulty product is received by the Guarantor. In specific cases the repair may be prolonged, and the Customer shall be informed about this fact immediately after delivering the faulty product to the Guarantor.
7. A product being subject of a complaint shall be delivered to the Guarantor by a courier service complete in an appropriate secure packaging with a detailed description of the fault and proof of purchase, after contacting the Guarantor, on Address: Luxon Sp. z o.o., ul. Kwiatowa 45, 55-330 Krępice In complete condition and adequately secured during transport, at the expense of the Purchaser together with a detailed description of the defect and proof of purchase, after contact with the Guarantor. After the repair, the Product is received by the Purchaser from the Guarantor at the aforementioned address or sent to the address indicated by the Purchaser.
8. The warranty repairs can be carried out only by the Guarantor or third part, indicated in writing by the Guarantor (hereinafter referred to as the “Service”).
9. The Guarantor shall have the right to refuse to repair the product if it is found that unauthorised repair attempts have been made.
10. The warranty period shall be prolonged by the time required for warranty repairs.
11. In case of the Buyer’s declared defect includes single light sources, their repair or replacement does not constitute a significant repair within the meaning of the rule article 581 § 1 of the Civil Code. In such cases, the warranty period is extended by the time during which, due to a defect in the Product, the Buyer was unable to use it. 581 § 1 of the Civil Code. 12. If the Guarantor chooses to trade the Product, but will be not able to do it because of the unavailability or cessation of production this Product, the Guarantor may reimburse the Purchaser for the amount paid by the Buyer for the Product, or replace the Product with another product of this same (or better) quality, which may however, vary slightly in terms of design and technical specifications.
13. This Warranty applies only to the Product that has been installed in accordance with the Manual or the Guarantor’s Guidelines and is used in accordance with the electrical values, operating and environmental specifications, application guidelines, IEC standards and other documents accompanying the Product.
14. This Warranty does not apply when the Product didn’t operate, what follows from chance event, force of circumstance, Product Misuse or use of the Product not in accordance with the Service Manual.
15. This Warranty excludes the Guarantor’s liability for the installation of the Product, Providing access to the Product, injury or other costs to the Buyer Including also related to the necessity disassembly and reassemble the Product.
16. This Warranty does not apply to defects in the Product resulting from:

  • due to improper operation of the Product,
  • as a result of use of the product for its intended purpose,

  • due to improper use of the Product, including mechanical damage,
  • during improper transportation or storage,
  • as a result of the Product’s operation at the wrong ambient temperature:
    1. for office products: from -20°C to +40°C
    2. for industrial products: from -25 ° C to + 45 ° C (note: for ultima: LED Pro – from -30 to + 55 ° C).

17. The warranty expires in the following cases:

  • as a result of self repair or structural modifications made by the Buyer or third party,
  • as a result of interfering in the Product, including in particular breaking the seal as a warranty Product.

18. The Guarantor shall not be held responsible for the punctuality of warranty repairs if his operation is disrupted by unpredictable conditions such as force majeure, delays in part shipment etc.
19. In cases not regulated herein, the regulations of Polish civil code shall apply.
20. The warranty is valid only with the Sales Agreement and the sales invoice.
21. Expressions beginning with the capital letter have the meaning specified in General Sales Terms.
